Glenn Greenwald passes on a reminder from Marty Lederman, to support Schumer's S.2468, which puts the question of the legality and Constitutionality of Bush's warrantless wiretapping directly onto the Supreme Court's docket. While Schumer is no Feingold, in general, he has been doing an effective job in pointing out the illegality of the President's actions.

The only problem is that he hasn't continued to trumpet it to the media.

I can't help but see this as "pushing it on down the road" on Schumer's part. Why subject FISA to constitutional challenge when it is obvious that as long as FISA is in place Bush has broken the law. If the Supremes decided that Bush's actions are illegal what is the remedy? A rebuke? Would such a holding trigger impeachment hearings even if the Republicans hold the majority?
